These Terms of Service, together with any documents they expressly incorporate by reference, constitute a legal agreement between you ("you," "your," "User") and Swiss Side ("we," "us," "our"). This Agreement contains important information regarding your rights and obligations, as well as conditions and limitations that apply to your access to and use of the Swiss Side Performance Platform ("the Service").
By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use the Service.
Age Requirement: You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. By registering, you confirm that you meet this requirement.
The Swiss Side Performance Platform provides decision support for ambitious triathletes and road cyclists. The Service includes recommendations on optimal tire pressures and wheel setups for bicycles, as well as data-driven recommendations for optimal pacing strategies and equipment choice. The recommendations are based on user-provided information, including rider and bike data, course files (e.g., GPX/FIT), and environmental conditions such as wind forecasts.
The Service, including its design, proprietary algorithms, calculation methods, software, and the resulting recommendations, are the exclusive property of Swiss Side.
License: We grant you a limited, non-exclusive, non-transferable license to use the results for your own performance-related purposes (including professional coaching or team management if applicable to your subscription).
Restrictions: You may not resell the Service, "white-label" the outputs as your own proprietary technology, or reverse-engineer the platform to extract underlying logic.
To access certain features of the Service, you are required to register for an account. You agree to provide accurate and complete information and to keep it current.
Authentication: We utilize a third-party identity provider (e.g., Auth0/Firebase) for authentication. By using the Service, you acknowledge and agree to their respective terms.
Security: You are responsible for maintaining the confidentiality of your credentials. Notify Swiss Side immediately of any unauthorized use or security breach.
10-Day Free Trial: We offer new users a one-time, 10-day free trial ("Trial Period") to explore the Service. This trial is intended to allow you to evaluate the platform’s compatibility with your equipment and performance needs.
No Automatic Conversion: Your Free Trial will not automatically convert into a paid subscription. We do not require credit card information to begin a trial. At the conclusion of the 10-day Trial Period, your access to premium features will expire unless you manually choose to purchase a paid subscription.
Paid Subscriptions: Once you voluntarily opt-in to a paid subscription, you authorize us and our third-party payment provider (Stripe) to charge the applicable fee to your designated payment method.
No Refund Policy: Because the 10-day Trial Period exists to ensure the Service meets your expectations before payment, all fees for paid subscriptions are non-refundable, except where required by mandatory local law. We do not provide refunds or credits for partial subscription periods, unused months, or "change of mind" after a purchase is completed.
Cancellation: You may cancel a paid recurring subscription at any time. The cancellation will be effective at the end of the then-current billing cycle, and you will retain access until that time.
Data after cancellation: After cancellation of your subscription, your account will stay active and your data (optimizations incl. results, courses, rider setups, ...) will be kept for 12 months. If you resubscribe, you will get access to your data again. After 12 months of non-subscription, you might loose access to your data.
Data License: By uploading data, you grant Swiss Side a license to host and process it to provide the Service. We may use anonymized and aggregated data to improve our performance models.
Compliance: You agree to use the Service in compliance with all applicable laws. You may not use the Service for any illegal purpose and agree not to violate any laws in your specific jurisdiction.
IMPORTANT: The recommendations provided by the Service are for informational and planning purposes only. Manufacturer Supersede: YOU ARE SOLELY RESPONSIBLE FOR ENSURING THAT ALL RECOMMENDATIONS, INCLUDING BUT NOT LIMITED TO TIRE PRESSURE, ARE WITHIN THE SAFETY LIMITS AND SPECIFICATIONS PROVIDED BY YOUR EQUIPMENT MANUFACTURERS (e.g., RIM AND TIRE MAXIMUM PRESSURE RATINGS).
Responsibility: Recommendations are not a substitute for professional coaching, technical expertise, or in-person verification. Swiss Side is not liable for any injuries, equipment damage, or accidents arising from your use of the platform's recommendations.
As-Is: The Service is provided on an "AS IS" basis. We do not warrant that the Service will be uninterrupted or error-free.
Liability Cap: To the maximum extent permitted by law, Swiss Side is not liable for any direct, indirect, incidental, or consequential damages. In no event shall our total liability exceed the amount paid by you for the Service in the 12 months preceding the claim.
You agree to indemnify and hold harmless Swiss Side and its employees from and against any claims, damages, or legal fees arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
Swiss Side reserves the right to modify or discontinue the Service or any part of it. We also reserve the right to adapt these Terms of Service. Continued use after changes constitutes acceptance.
These terms are governed by the laws of Zurich, Switzerland.
Dispute Resolution: Parties agree to attempt to resolve disputes through good-faith negotiations first. If no resolution is reached, disputes shall be submitted to mediation in Zurich. If mediation fails, disputes shall be brought before the competent courts of Zurich, Switzerland.
From time to time, Swiss Side may offer promotional codes, discounts, or other special offers ("Codes"). Use of these Codes is subject to the following rules:
Non-Stacking: Unless explicitly stated otherwise, Codes cannot be combined. Only one Code may be applied per transaction or subscription period.
No Cash Value: Codes have no cash value, are non-transferable, and cannot be exchanged for currency or credit toward previous purchases.
Expiration: Each Code is valid for a limited time as specified at the time of issuance. We reserve the right to modify or terminate a Code at any time without notice.
Abuse & Fraud: We reserve the right to void any Code and/or cancel any subscription if we suspect a Code was obtained or used through fraud, mistake, or in violation of these Terms (e.g., sharing a one-time-use referral code on a public coupon site).
Interaction with Free Trial: Codes generally cannot be applied to the 10-day Free Trial. If a Code provides a discount on a paid subscription, it will typically be applied to the first billing cycle following the manual conversion from a Trial to a Paid account.
